The client employed a new Personnel Manager, who introduced a new set of disciplinary rules and procedures. An employee committed what the company believed to be an act of gross misconduct; he was disciplined and dismissed using the new procedure. He claimed the dismissal was unfair. The company believed this to be a public test of the new procedures, and wanted to prove to the workforce that it would use them firmly but fairly. Solicitors advised settlement of the case due to costs. First Business Support took the case on and won it at Tribunal. Since then the company has not had another unfair dismissal claim made against it.
