employed a new Personnel Manager, who introduced a new set of disciplinary
rules and procedures. An employee committed what the company believed
to be an act of gross misconduct; he was disciplined and dismissed using
the new procedure. He claimed the dismissal was unfair. The company believed
this to be a public test of the new procedures, and wanted to prove to
the workforce that it would use them firmly but fairly. Solicitors advised
