The client lost a household waste
collection contract to a local authority, which took the work back in-house.
The council refused
to accept that
TUPE applied to the transaction and refused to employ a number of the
client’s staff who had worked on the contract. Those staff members
brought claims of unfair dismissal against our client and the council.
First Business Support defended the client at the Employment Tribunal,
and successfully obtained a ruling that TUPE did apply, and, therefore,
the
employees
had been unfairly dismissed by the council.
