Also on the 1st October, the
Trade Union & Labour Relations
(Consolidation) Act 1992 will be amended to reflect the decision of the
European Court of Justice last year in Junk v Kuhnel which deals with
collective redundancies (where 20 or more people may be dismissed). The
amendment means that no employee being made redundant can be issued with
notice of redundancy until the statutory consultation period (either
30 or 90 days depending on the numbers involved) has concluded. The case
also highlighted the emphasis on using the consultation process as a
means of avoiding redundancies.
